Regional Sponsored Migration Scheme (Subclass 187) Visa - Information for Current Holders of a Temporary Work Visa (Subclass 482/457) wanting to Apply for a Permanent Visa under the Regional Sponsored Migration Scheme (Subclass 187)

The Regional Sponsored Migration Scheme (Subclass 187) was repealed on the 16 November 2019 and replaced by the new Skilled Employer Sponsored Regional (Provisional) visa (Subclass 494) however transitional arrangements do exist for those who happen to have held (or applied for and been subsequently granted) a Temporary Skilled Shortage (Subclass 457 / 482) prior to this date.

The transitional arrangements mean that it is still possible for subclass 457 / 482 holders to make an application for the Regional Sponsored Migration Scheme (Subclass 187) through the Temporary Resident Transition stream provided they satisfy all relevant criteria.


TEMPORARY RESIDENT TRANSITION STREAM

Persons who have worked in Australia for a minimum period of 3 in the past 4 years as the holder of a Temporary Skilled Shortage (Subclass 457 / 482) visa may still be eligible to apply for a permanent visa under the Regional Sponsored Migration Scheme (Subclass 187) through the Temporary Resident Transition stream.

To satisfy the requirements for the Temporary Resident Transition stream, applicants must:

  • 1. Have worked for the Employer (or an associated entity) in the same position for a minimum period of three years (unless transitional arrangements apply);
  • 2. Be nominated again by the same Employer to continue to work in the same position;
  • 3. Have the appointment approved by the relevant Regional Certifying Body;
  • 4. Be less than 45 years of age (unless exemptions apply);
  • 5. Have Competent level English;
  • 6. Be registered or licensed with the relevant authority (if required for the occupation);
  • 7. Be paid at the market salary rate.

Note: The Employer must also be able to demonstrate that they cannot fill the position with a suitably qualified Australian or approved temporary visa holder before nominating the Applicant to fill the position and therefore labour market testing is required unless exemptions apply.

Obligations as a Permanent Employer Sponsored Visa Holder

This is a Permanent visa allowing the holder to remain in Australia indefinitely. There are no work or study restrictions placed upon this visa.
